Verify all regulations with MFWP before your trip. Hunting and fishing regulations are set by Montana Fish, Wildlife & Parks. Violations carry criminal penalties including fines, license revocation, and equipment forfeiture. PeakScout summarizes MFWP data for convenience — it is not a substitute for reading the current official regulations. Always verify at fwp.mt.gov.
📂 1. Data Source & Update Cadence

PeakScout's Montana hunting and fishing information is derived from:

  • MFWP Hunting Regulations Digest — Published annually, typically in spring. Season dates, bag limits, zone boundaries, and special regulations are extracted from the current year's digest at the time of our data update.
  • MFWP Fishing Regulations — Annual statewide and special regulations, including tributary-specific rules, size/bag limits, and gear restrictions.
  • Block Management Area (BMA) data — Season-opening access status for enrolled MFWP Block Management properties (6.2M+ acres across 4 regional offices).
  • MFWP Chronic Wasting Disease (CWD) zone designations — Updated as new counties or hunting districts are added to the CWD zone.
⚠️
Mid-season emergency changes. MFWP can issue emergency regulation changes, special restrictions, and CWD zone expansions after the annual digest is published. PeakScout may not reflect these mid-season changes in real time. Check fwp.mt.gov for the most current effective regulations before each outing.
📅 2. Season Date & Boundary Accuracy

Montana's hunting system divides the state into hundreds of Hunting Districts (HDs) with different season dates, quotas, and weapon restrictions for each species. PeakScout displays:

  • General season dates for major species (elk, deer, antelope, bear, pheasant, grouse, turkey)
  • Archery, rifle, and late-season season windows where commonly applicable
  • Draw-only seasons are noted as draw-required but specific quota allocations are not displayed

PeakScout does NOT display:

  • Hunting District-specific dates (only statewide or regional summaries)
  • Permit quota fill rates or remaining permit counts
  • Special restrictions within individual HDs (antler point restrictions, antlerless-only units)
  • Tribal land regulations or reservation hunting rules
  • Wolf and mountain lion season closures triggered by harvest quotas in specific HDs
⚠️
Wolf & mountain lion season closures: Wolf and mountain lion seasons in specific hunting districts can close mid-season when harvest quotas are reached. PeakScout does not track real-time quota closure status. Verify at fwp.mt.gov or call MFWP dispatch before hunting these species.
🪪 3. License & Tag Requirements

Montana requires hunters and anglers to carry valid licenses, tags, and permits while afield. Requirements vary by:

  • Residency status: Montana resident vs. non-resident fees and license structures differ significantly. PeakScout displays general information only — it does not determine whether you qualify as a Montana resident.
  • Species-specific tags: Many species (elk, deer, antelope, sheep, moose, goat, bison) require species-specific tags in addition to a base hunting license. Some tags are unlimited-over-the-counter (OTC); others require a draw that closes months before the season.
  • Conservation licenses: Montana requires a Conservation License as the base for all hunting and fishing licenses.
  • Fishing licenses: Both resident and non-resident annual and 2-day/season licenses are available. Tribal waters (Flathead Lake, portions of the Flathead River) may require a separate tribal fishing permit regardless of state license status.

PeakScout does not sell licenses or verify license status. Purchase and verify all required licenses at fwp.mt.gov/hunting or from an authorized license agent before your trip.

🎣 4. Fishing Waters & Special Regulations

PeakScout features 11 major Montana fishing waters with general conditions and run timing information. The following data limitations apply:

WaterKnown Complexity
Flathead Lake Tribal fishing permit required for portions under Confederated Salish and Kootenai Tribes jurisdiction. State license alone is insufficient.
Flathead River (main stem) Different regulations above/below Kerr Dam. Tribal waters designation varies by section.
Smith River Permit lottery required for floating; day-use fishing permits also required. Highly competitive draw.
Missouri River (Craig section) Catch-and-release and selective gear rules apply to portions. Verify current regs for specific access points.
Big Hole River Arctic grayling sanctuary areas with gear restrictions and no-kill zones. Verify at fwp.mt.gov.
Yellowstone River Montana and Wyoming regulations differ; Yellowstone NP waters have NPS-specific rules distinct from state regulations.
All waters PeakScout run timing and stocking intel reflects historical averages — verify actual conditions with MFWP fish stocking reports.
🦌 5. Chronic Wasting Disease (CWD) Zone Caveats

Montana has established CWD zones in portions of the state where Chronic Wasting Disease has been detected or is considered at high risk. These zones carry mandatory carcass transportation restrictions (ban on transporting intact spines and heads out of zone) and enhanced sampling requirements.

PeakScout displays MFWP CWD zone information for reference. This data:

  • May lag actual MFWP zone expansions — CWD zones can be expanded by administrative order without the annual regulation cycle
  • Does not include CWD check station locations (open seasonally and vary by year)
  • Does not reflect multi-state import restrictions for carcasses crossing state lines

Always verify current CWD zone boundaries and transport rules at fwp.mt.gov/hunting/regulations/cwd before harvesting any deer, elk, or moose.

🗺️ 6. Block Management Access Disclaimers

Montana's Block Management Program provides access to approximately 6.2 million acres of private land for hunting. PeakScout displays regional access summary data for 4 BMA regions (Northwest, Northeast, Southeast, Southwest).

⚠️
BMA access is property-specific and changes annually. Individual landowner participation varies each season. A BMA that was accessible last year may not be enrolled in the current year, or may have new access restrictions (walk-in only, foot traffic only, no camping). PeakScout does not display individual BMA parcel boundaries or current-year access status for specific properties.

Before accessing any BMA:

  • Obtain the current-year Block Management Area Hunter Access Map from MFWP
  • Comply with all posted access rules at the property boundary
  • Never access an enrolled BMA without a current-year hunting license in hand
  • Follow BMA-specific rules: many require registration at access points or limit party size

⚖️ 7. Applicable Montana Law
Wildlife Ownership — MCA § 87-1-102

Under MCA § 87-1-102, all wild bison, deer, elk, antelope, moose, caribou, mountain sheep, mountain goats, mountain lions, bears (other than grizzlies under federal ESA), wild turkeys, and all wild birds are the property of the state of Montana. Taking any such wildlife without a valid license and tag constitutes criminal poaching regardless of where the taking occurs.

Hunting Without License — MCA § 87-3-101 to 87-3-130

Hunting without a license, hunting in closed seasons, exceeding bag limits, or taking protected species carries criminal penalties under Montana law. First-offense license revocation is mandatory for many violations. Restitution values for unlawfully taken wildlife can reach $10,000+ for trophy species.

PeakScout's hunting and fishing data is provided for informational planning purposes only and does not constitute legal advice. Consult MFWP or a licensed Montana attorney for regulatory guidance.

Montana Recreation Responsibility Act — MCA § 27-1-736

Landowners who permit hunting and fishing access without a charge receive liability protection under MCA § 27-1-736. This does not limit your obligation to comply with all applicable hunting and fishing regulations while on their property.
